1. Acceptance of Terms

By accessing or using Bombajom Patterns ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.

These Terms constitute a legally binding agreement between you and Bombajom Patterns. Please read them carefully before using our Service.

2. Description of Service

Bombajom Patterns is a web-based SaaS application that enables users to digitally modify PDF sewing patterns, including fit adjustments such as Full Bust Adjustments (FBA) and Small Bust Adjustments (SBA). The Service processes user-uploaded PDF files and provides modified pattern files for download.

We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice.

3. Eligibility

You must be at least 16 years old to use the Service. By using the Service, you represent and warrant that:

You are at least 16 years of age
You have the legal capacity to enter into these Terms
Your use of the Service does not violate any applicable law or regulation
You are not located in a country subject to a U.S. Government embargo

4. User Accounts

4.1 Registration

You must create an account to use certain features of the Service. You agree to:

Provide accurate, current, and complete information during registration
Maintain and promptly update your account information to keep it accurate
Maintain the security and confidentiality of your password
Accept responsibility for all activities that occur under your account
Notify us immediately of any unauthorized use of your account
Not share your account credentials with others

4.2 Account Termination

We reserve the right to suspend or terminate your account at any time, with or without notice, for:

Violation of these Terms
Fraudulent or illegal activity
Conduct that harms other users or our business
Extended periods of inactivity (with prior notice)
Any other reason we deem necessary to protect the Service and its users

You may terminate your account at any time through your account settings or by contacting us at support@bombajom.com.

5. Acceptable Use

You agree not to:

Upload files containing malware, viruses, or other harmful code
Upload copyrighted material without proper authorization from the copyright holder
Use the Service for any illegal purpose or in violation of any applicable laws
Attempt to reverse engineer, decompile, or disassemble the Service
Interfere with or disrupt the Service, servers, or networks
Use automated systems (bots, scrapers, crawlers) to access the Service without permission
Impersonate any person or entity or misrepresent your affiliation
Collect or harvest user data without authorization
Transmit spam, chain letters, or other unsolicited communications
Circumvent any access control or rate-limiting features
Engage in any activity that could damage, disable, or impair the Service

6. Intellectual Property

6.1 Service Ownership

The Service, including all software, algorithms, designs, text, graphics, user interface, and other content (excluding User Content), is owned by Bombajom Patterns and is protected by copyright, trademark, patent, and other intellectual property laws.

The Bombajom Patterns name, logo, and related marks are trademarks of Bombajom Patterns. You may not use these marks without our prior written consent.

6.2 User Content

You retain ownership of PDF patterns, measurements, and other content you upload ("User Content"). By uploading User Content, you grant us a limited, non-exclusive, royalty-free license to:

Store and process your User Content to provide the Service
Create modified versions of your patterns as you request
Use anonymized, aggregated data for service improvement and analytics

You represent and warrant that:

You own or have the right to use and upload User Content
User Content does not infringe on any third-party intellectual property rights
User Content complies with all applicable laws

6.3 Copyright Infringement (DMCA)

We respect intellectual property rights and expect users to do the same. If you believe your copyright has been infringed, please send a notice to legal@bombajom.com containing:

Your contact information
Description of the copyrighted work
Location of the allegedly infringing material
Statement of good faith belief that use is not authorized
Statement under penalty of perjury that you are the copyright owner
Your physical or electronic signature

7. Payments and Subscriptions

7.1 Pricing

The Service offers both free and paid subscription plans. Current pricing is displayed on our pricing page. All prices are in USD unless otherwise stated and are exclusive of applicable taxes.

7.2 Payment Processing

Payments are processed securely through Stripe, Inc. By making a purchase, you agree to Stripe's Terms of Service. We do not store your credit card information on our servers.

7.3 Billing and Renewal

Subscriptions are billed in advance on a recurring basis (monthly or annually)
Subscriptions automatically renew unless cancelled before the renewal date
You authorize us to charge your payment method on file for renewal
Failed payments may result in suspension of your account

7.4 Cancellation

You may cancel your subscription at any time through your account settings
Cancellation takes effect at the end of the current billing period
You will retain access to paid features until the end of your billing period
No prorated refunds are provided for partial billing periods

7.5 Price Changes

We reserve the right to change subscription prices. We will provide at least 30 days' notice before any price increase takes effect. Continued use after a price change constitutes acceptance of the new price.

7.6 Refunds

Refunds are considered on a case-by-case basis. To request a refund, contact us at support@bombajom.com within 14 days of your purchase. Refunds are not guaranteed and are at our sole discretion.

8. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access to the Service. The Service may be unavailable due to:

Scheduled maintenance (we will provide advance notice when possible)
Emergency maintenance or security updates
Technical issues, bugs, or outages
Third-party service provider issues
Force majeure events beyond our reasonable control

We will make reasonable efforts to restore service promptly and communicate with affected users during outages.

9. Disclaimers

9.1 No Warranty

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE.

9.2 Pattern Accuracy

While we use industry-standard algorithms for pattern adjustments, we do not guarantee the accuracy, fit, or suitability of modified patterns. Pattern adjustments are provided as a tool to assist with your sewing projects.

YOU ARE SOLELY RESPONSIBLE FOR:

Testing and verifying pattern adjustments before cutting fabric
Creating muslin or toile test garments when appropriate
Making additional adjustments as needed for proper fit
Any fabric, materials, or time used based on modified patterns

9.3 Third-Party Services

The Service may contain links to or integrations with third-party services. We are not responsible for the content, privacy practices, or availability of such services.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

BOMBAJOM PATTERNS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES
OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) $100 USD
THESE LIMITATIONS APPLY REGARDLESS OF THE LEGAL THEORY (CONTRACT, TORT, OR OTHERWISE) AND EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.

11. Indemnification

You agree to indemnify, defend, and hold harmless Bombajom Patterns, its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to:

Your use or misuse of the Service
Your violation of these Terms
Your violation of any third-party rights, including intellectual property rights
User Content you upload, share, or otherwise make available
Your negligence or willful misconduct

12. Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information. Please review our Privacy Policy carefully.

13. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the State of Utah, United States, without regard to its conflict of law provisions.

Any legal action or proceeding arising under these Terms shall be brought exclusively in the federal or state courts located in Salt Lake County, Utah, and you hereby consent to the personal jurisdiction and venue of such courts.

13.1 For EU/EEA Users

If you are a consumer in the European Union or European Economic Area, you may also bring proceedings in the courts of your country of residence. Nothing in these Terms affects your rights as a consumer under applicable mandatory consumer protection laws.

14. Dispute Resolution

14.1 Informal Resolution

Before initiating any formal dispute resolution, you agree to contact us at legal@bombajom.com to attempt to resolve the dispute informally. We will attempt to resolve disputes within 30 days of receiving your notice.

14.2 Binding Arbitration

If informal resolution fails, any dispute arising from these Terms or the Service shall be resolved through binding arbitration administered by JAMS (Judicial Arbitration and Mediation Services) in accordance with its Streamlined Arbitration Rules and Procedures.

Arbitration shall take place in Salt Lake City, Utah, or remotely at your election
The arbitrator's decision shall be final and binding
Each party shall bear its own costs, with arbitration fees split equally

14.3 Class Action Waiver

YOU AGREE TO RESOLVE DISPUTES WITH US ON AN INDIVIDUAL BASIS ONLY, AND NOT AS PART OF ANY CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION.

14.4 Exceptions

Either party may seek injunctive relief in court for intellectual property infringement or violation of confidentiality obligations. Small claims court actions are also exempt from the arbitration requirement.

15. Changes to Terms

We reserve the right to modify these Terms at any time. When we make changes:

We will update the "Last updated" date at the top of this page
For material changes, we will notify you via email or prominent notice in the Service
We will provide at least 30 days' notice before significant changes take effect

Your continued use of the Service after changes become effective constitutes acceptance of the modified Terms. If you do not agree to the changes, you must stop using the Service and may cancel your subscription.

16. General Provisions

16.1 Entire Agreement

These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and Bombajom Patterns regarding the Service.

16.2 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

16.3 Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

16.4 Assignment

You may not assign or transfer your rights under these Terms without our prior written consent. We may assign our rights without restriction.

16.5 Force Majeure

We shall not be liable for any failure to perform due to causes beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, labor disputes, power outages, or government actions.
